Please do not use the Website if you do not agree to these Terms.

1. Definitions

In these Terms:

  • “Company,” “ISSAFE,” “we,” “us,” and “our” mean TULIP ELASTICS INDUSTRIES PRIVATE LIMITED, operating under the ISSAFE brand.
  • “Website” means issafesafety.com and its related webpages, enquiry forms, quotation tools, customer-account functions, and checkout facilities.
  • “Customer,” “buyer,” “you,” and “your” mean any visitor, customer, purchaser, company, organisation, or authorised representative using the Website.

3. Eligibility and Authority

By using the Website, you confirm that:

  • You are legally capable of entering into a binding agreement;
  • You are using the Website for lawful purposes;

  • Issue an accepted Order confirmation;
  • Confirm dispatch; or

We may contact you to verify Order, payment, delivery, identity, or business information before acceptance or dispatch.

6. Product Information

We make reasonable efforts to keep Product descriptions, photographs, specifications, dimensions, colours, materials, features, certifications, prices, and availability accurate.

However:

  • Product images are provided for identification and general reference;
  • Colours and appearance may vary because of lighting, photography, screen settings, manufacturing batches, or permitted production variations;
  • Packaging may change without prior notice;
  • Technical specifications may be corrected or improved;
  • Accessories shown in an image may not be included unless expressly stated;
  • Certificates and compliance statements apply only to the specific model and configuration identified; and
  • Product availability may change before an Order is accepted.

A minor difference that does not materially affect Product function, safety, or stated compliance will not automatically make a Product defective.

Where information on a Product page conflicts with an accepted written quotation, proforma invoice, specification sheet, or Order confirmation, the most recent expressly accepted written document will apply.

7. Safety-Critical Products and Professional Responsibility

Many ISSAFE Products are safety-critical products, including fall-protection, PPE, rescue, height-safety, confined-space, fire-safety, and industrial safety equipment.

Website information is provided for general product identification and purchasing assistance. It does not replace:

  • A site-specific risk assessment;
  • Professional engineering advice;
  • Product training;
  • Competent-person supervision;
  • A rescue plan;
  • Applicable safety standards;
  • Manufacturer instructions; or
  • Local legal and regulatory requirements.

Products must be selected, fitted, installed, inspected, maintained, stored, and used:

  • For their intended purpose;
  • By properly trained and competent persons where required;
  • Within stated weight, load, environmental, and application limitations;
  • With compatible components and approved systems;
  • After pre-use inspection;
  • According to applicable instructions, standards, and laws; and
  • With an appropriate emergency and rescue plan.

The buyer, employer, site controller, installer, competent person, and user are responsible for confirming that the selected Product and complete system are appropriate for the intended application.

ISSAFE is not responsible for loss, injury, accident, or damage caused by misuse, incorrect selection, incompatible equipment, unauthorised modification, improper installation, failure to inspect, poor maintenance, incorrect storage, overloading, chemical exposure, sharp-edge exposure, use after a fall, or use contrary to instructions.

Nothing in these Terms excludes liability that cannot legally be excluded.

8. Certifications and Compliance

Any statement that a Product is certified, tested, approved, compliant, or conforming to a standard applies only to:

  • The specific Product model;
  • The stated configuration;
  • The applicable certificate scope;
  • The identified manufacturing or test conditions; and
  • The standard version expressly referenced.

A certificate for one Product or configuration must not be assumed to apply to another Product, component, modification, colour, size, or customised version.

Before purchasing, the customer must confirm whether the Product satisfies the intended country, industry, workplace, project, tender, and site requirements.

For international Orders, the buyer is responsible for confirming local import, labelling, registration, certification, language, and end-use requirements unless ISSAFE expressly agrees otherwise in writing.

9. Accounts and Login Security

Where customer-account functionality is available, you are responsible for:

  • Keeping login details confidential;
  • Providing accurate account information;
  • Restricting unauthorised access to your account; and
  • All activities conducted through your account.

You must notify us promptly if you suspect unauthorised access or account misuse.

We may suspend or close accounts containing false information or used for fraud, misuse, or violation of these Terms.

10. Quotations and Bulk Enquiries

A quotation is valid only for the period stated in it. If no validity period is stated, it may be revised or withdrawn before Order acceptance.

A quotation may be subject to:

  • Minimum Order quantities;
  • Product availability;
  • Sample approval;
  • Technical approval;
  • Payment terms;
  • Freight and insurance;
  • Taxes and duties;
  • Currency fluctuations;
  • Raw-material availability;
  • Production capacity; and
  • Applicable compliance requirements.

Unless expressly accepted by ISSAFE in writing, terms appearing in a customer purchase order, vendor portal, email, or other customer document will not replace or modify these Terms or ISSAFE’s quotation.

11. Custom, Private-Label, and Made-to-Order Products

Custom Orders may include private-label products, special colours, customer branding, modified specifications, customised packaging, bulk-production Orders, or Products manufactured specifically for the customer.

Before production, customers may be required to approve:

  • Artwork;
  • Logos;
  • Product specifications;
  • Samples;
  • Colours;
  • Labelling;
  • Packaging;
  • Quantity;
  • Price; and
  • Production timeline.

The customer is responsible for verifying all approved information before production.

After written approval, payment confirmation, or commencement of production, a Custom Order may not be cancelled, returned, exchanged, or refunded except where:

  • ISSAFE agrees in writing;
  • A verified manufacturing defect exists; or
  • Applicable law requires otherwise.

The customer confirms that it owns or has permission to use all logos, trademarks, artwork, specifications, and content supplied to ISSAFE. The customer is responsible for claims arising from unauthorised materials supplied by it.

Reasonable manufacturing tolerances may apply to colour, measurements, components, packaging, quantity, and other production characteristics where permitted by the accepted specification.

12. Orders and Order Acceptance

Every Order is subject to:

  • Product availability;
  • Payment confirmation;
  • Fraud and verification checks;
  • Delivery-service availability;
  • Export or import restrictions;
  • Applicable legal requirements; and
  • Final acceptance by ISSAFE.

We may accept, reject, limit, hold, or cancel an Order where reasonably necessary, including because of:

  • Product unavailability;
  • Pricing or description errors;
  • Payment failure;
  • Suspected fraud;
  • Unverified customer information;
  • Unusual Order quantity;
  • Legal or regulatory restrictions;
  • Delivery limitations;
  • Website or system error; or
  • Force-majeure circumstances.

Where an Order is cancelled after valid payment has been received, an applicable refund will be initiated to the original payment method, subject to payment-provider processing timelines and lawful deductions, if any.

13. Pricing and Currency

Prices displayed on the Website are in Indian Rupees unless another currency is expressly shown.

For Indian Orders:

  • Applicable GST treatment will be shown on the Product page, invoice, checkout, or Order confirmation;
  • Shipping and handling charges, where applicable, will be displayed or communicated before final acceptance; and
  • The final payable amount will be shown at checkout or in the accepted quotation.

For international Orders:

  • Product prices may exclude import duties, customs charges, destination taxes, brokerage, clearance fees, local registration costs, and similar charges unless expressly stated otherwise;
  • The buyer is responsible for destination-country charges and obligations unless the accepted quotation or shipping term states otherwise; and
  • Currency conversion and bank charges may apply.

Prices may be revised before Order acceptance because of changes in raw-material costs, taxes, duties, exchange rates, freight, government requirements, or other business conditions.

After an Order has been finally accepted, its price will not be changed except where the customer requests changes or where expressly permitted by the accepted Order terms.

14. Pricing, Content, and Technical Errors

Despite reasonable checks, the Website may contain typographical, pricing, availability, freight, technical, or content errors.

Where a material error is identified, we may:

  • Correct the information;
  • Request customer confirmation;
  • Refuse or cancel the affected Order; or
  • Offer an alternative Product or revised quotation.

Where payment has already been received for an Order cancelled because of a confirmed error, an applicable refund will be initiated.

We will not intentionally advertise Products at misleading prices or refuse to honour a valid accepted transaction without a legitimate reason.

15. Payments

Available payment methods may be displayed during checkout or stated in a quotation.

By submitting payment, you confirm that:

  • You are authorised to use the payment method;
  • The billing and transaction details are accurate;
  • The funds are lawfully available; and
  • The payment does not violate applicable laws.

Payments may be processed by authorised third-party payment providers. ISSAFE does not intend to store complete card numbers, CVV codes, or banking passwords on its own systems.

An Order will not be processed until payment is successfully received and verified, unless written credit terms have been approved by ISSAFE.

16. Fraud Prevention and Transaction Verification

To protect customers and prevent fraudulent transactions, ISSAFE may conduct reasonable:

  • Identity verification;
  • Address verification;
  • Payment verification;
  • Telephone or email confirmation;
  • Business verification;
  • Order-pattern review;
  • IP or device review; and
  • Other lawful fraud-prevention checks.

We may request supporting information where an Order appears unusual, inconsistent, high-risk, unauthorised, or potentially fraudulent.

We will not request your complete payment password, card PIN, CVV, or one-time password through ordinary email, telephone, or messaging communication.

If required verification is not completed within the period communicated by us, we may place the Order on hold or cancel it.

17. Chargebacks and Payment Disputes

Customers should contact ISSAFE promptly regarding an unrecognised transaction, delivery concern, cancellation request, or refund issue.

Submitting a false, misleading, abusive, or fraudulent chargeback may result in:

  • Suspension of the customer account;
  • Cancellation of pending Orders;
  • Submission of transaction and delivery evidence to the payment provider; and
  • Recovery action where legally permitted.

Nothing in this section prevents a customer from exercising legitimate rights through its bank, payment provider, or applicable law.

18. Shipping and Delivery

Shipping and delivery timelines are estimates unless expressly guaranteed in writing.

Delivery may be delayed because of:

  • Product availability;
  • Customisation or production requirements;
  • Payment verification;
  • Courier or freight delays;
  • Customs clearance;
  • Incorrect or incomplete addresses;
  • Public holidays;
  • Strikes;
  • Weather conditions;
  • Government restrictions;
  • War, civil disturbance, epidemic, or pandemic;
  • Transport interruption; or
  • Other events outside reasonable control.

Customers must provide complete and accurate delivery details. ISSAFE is not responsible for delay, loss, or additional charges caused by incorrect information supplied by the customer.

We may make partial shipments where reasonable and will communicate this where applicable.

19. Domestic and International Delivery

For domestic Orders, delivery charges and available delivery methods will be shown at checkout or stated in the Order confirmation.

For international Orders:

  • The applicable shipping term will be stated in the quotation or Order confirmation;
  • The customer may be responsible for import clearance, licences, permits, customs duties, destination taxes, inspections, and local fees;
  • Delivery timelines may be affected by customs and local authorities;
  • Products may be opened or inspected by customs authorities; and
  • The buyer must provide documents and information reasonably required for export and import processing.

Where no international shipping term is expressly stated, responsibilities will be determined by the accepted quotation, invoice, shipping document, and applicable law.

20. Risk, Ownership, and Delivery Inspection

Risk of loss or damage will pass according to the agreed delivery or shipping terms.

Where legally permitted, ownership of Products remains with ISSAFE until full payment has been received.

You should inspect the shipment promptly after delivery and report:

  • Visible transit damage;
  • Missing packages;
  • Wrong Products;
  • Quantity shortages; or
  • Material packaging damage

within the time stated in the Shipping Policy, Return and Refund Policy, or applicable Order communication.

You should retain the invoice, packaging, labels, batch information, photographs, and unboxing evidence where a claim is submitted.

21. Cancellations

Customers should request cancellation as soon as possible.

Cancellation may not be available after an Order has been:

  • Accepted;
  • Processed;
  • Packed;
  • Dispatched;
  • Customised;
  • Private-labelled; or
  • Entered into production.

ISSAFE may cancel an Order before dispatch because of product unavailability, suspected fraud, pricing error, legal restrictions, non-payment, failed verification, or force majeure.

Any approved refund will be processed according to the applicable Return, Refund, and Cancellation Policy.

22. Returns, Replacements, Exchanges, and Refunds

Returns, replacements, exchanges, and refunds are governed by the separate Return, Refund, Exchange, and Cancellation Policy published on the Website.

Unless otherwise stated or required by applicable law:

  • Products are not returnable merely because of a change of mind, incorrect customer selection, or non-technical preference;
  • Custom Orders, private-label Orders, and made-to-order Products are generally non-returnable;
  • Used, altered, damaged, contaminated, expired, incomplete, or non-resalable Products may not be eligible;
  • Claims must be supported by the invoice, photographs, packaging, batch information, and other reasonably requested evidence; and
  • Products must not be used after a suspected defect, fall event, damage, or safety concern.

Nothing in these Terms limits non-waivable consumer rights.

The policy and actual support process must remain clear, accessible, and operational.

23. Warranty

Any Product warranty applies only where expressly stated on the Product page, warranty document, invoice, or accepted written communication.

Unless expressly stated otherwise:

  • Warranty is limited to verified manufacturing defects;
  • Proof of purchase is required;
  • The Product may need to be inspected before a decision is made;
  • ISSAFE may repair, replace, provide an appropriate remedy, or reject an unsupported claim after technical evaluation;
  • Replaced Products or parts may need to be returned to ISSAFE;
  • A repair or replacement does not restart or extend the original warranty period unless stated in writing; and
  • Customers must follow authorised return and transport instructions.

Warranty does not cover:

  • Normal wear and tear;
  • Product ageing or expiry;
  • Misuse or incorrect selection;
  • Overloading;
  • Fall-arrest loading or impact events;
  • Improper storage or maintenance;
  • Failure to inspect;
  • Accidental or transit damage after risk has passed;
  • Unauthorised repair or modification;
  • Chemical, heat, flame, UV, corrosion, or sharp-edge exposure outside stated limits;
  • Use with incompatible equipment; or
  • Use contrary to instructions, training, standards, or law.

Statutory rights that cannot legally be excluded remain unaffected.

24. Intellectual Property

All Website content, including text, product descriptions, graphics, photographs, videos, logos, layouts, designs, downloads, brochures, catalogues, technical documents, manuals, illustrations, and software elements, is owned by or licensed to TULIP ELASTICS INDUSTRIES PRIVATE LIMITED.

Where legally permitted, ISSAFE’s total aggregate liability relating to a specific Product or Order will not exceed the amount paid to ISSAFE for that specific Product or Order.

This limitation does not apply where a higher liability is required by applicable law or where liability cannot legally be limited.

31. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless TULIP ELASTICS INDUSTRIES PRIVATE LIMITED, ISSAFE, and their directors, officers, employees, and authorised representatives against claims, losses, damages, penalties, and reasonable costs resulting from:

ISSAFE may reject, hold, or cancel an Order where:

  • A destination is restricted;

  • The purchaser, consignee, or end user cannot be verified; or
  • The stated end use creates a legal or safety concern.

The international buyer is responsible for providing accurate consignee, end-user, destination, and import information.

33. Anti-Bribery and Ethical Conduct

Customers, agents, distributors, representatives, and business partners must not offer, request, authorise, or accept unlawful bribes, kickbacks, facilitation payments, or improper benefits relating to ISSAFE transactions.

ISSAFE may cancel or terminate a transaction where unlawful or unethical conduct is reasonably suspected.

34. Force Majeure

ISSAFE will not be responsible for delay or failure caused by events outside its reasonable control, including:

  • Natural disasters;
  • Fire or flood;
  • War or terrorism;
  • Civil disturbance;
  • Government action;
  • Trade restrictions;
  • Strikes;
  • Transport disruption;

  • Port congestion;
  • Customs delay; or
  • Failure of essential third-party services.

We will take reasonable steps to communicate and manage the affected Order.

35. Suspension and Termination

  • Security threats;
  • Unlawful conduct;
  • Non-payment;

These Terms, together with the accepted quotation, Order confirmation, invoice, Product-specific terms, and policies published on the Website, form the agreement governing the transaction.

Where documents conflict, the following order will generally apply:

  1. An expressly signed or accepted written agreement;
  2. The accepted quotation or Order confirmation;
  3. Product-specific warranty or written Product terms;
  4. The applicable Return, Refund, Shipping, or Privacy Policy; and
  5. These Terms and Conditions.

No verbal statement changes these Terms unless confirmed by an authorised ISSAFE representative in writing.

41. Governing Law and Jurisdiction

These Terms are governed by the laws of India.
